CONCERNING
CIRCULATION OF CITRUS SEED
THE MINISTER OF AGRICULTURE,
Considering:
- a. that by Decree of the Minister of Agriculture No. 737/Kpts/TP.630/11/1986, it has stipulated the provision regarding the transportation of citrus plants and/or citrus seed to prevent the dissemination of CVPD disease;
- b. that with the Integrated Pest Management system as referred to in Law of the Republic of Indonesia No. 12 of 1992 concerning Plant Cultivation System, all type of citrus disease, including CVPD, shall be minimized, thus economically will not be caused damage;
- c. that to preserve the quality of citrus seed, it requires to control its circulation;
- d. that based on the above mentioned matters, it is deemed necessary to re-regulate the circulation of citrus seeds.

DECREE OF THE MINISTER OF AGRICULTURE CONCERNING CIRCULATION OF CITRUS SEED
CHAPTER I
GENERAL PROVISION
Article 1
As used in this decision:
- a. Citrus seed means plant or parts there of which came into use for reproduction and/or multiplication of citrus plant;
- b. Circulation of citrus seed means activities or set of activities in circulating citrus seeds, either for trading or not;
- c. Trader means individual, legal agency, or government institution which perform activities or set of activities in distributing citrus seeds, either for trading or not;
- d. Entry and exit points means seaport, river port, cross port, airport, post office, border post to other countries, and other necessary considered places, which are designated as entry and/or exit point of citrus seeds;
- e. Label means written description given on the citrus seeds or packaging of citrus seeds, which will be circulated and contains include place of origin, type and variety of plant, class, health certificate, and expiration of circulation period of seed.
CHAPTER II
CIRCULATION OF CITRUS SEEDS
Article 2
(1) Citrus seeds which are circulated may originally come from domestic production and/or importation from overseas in accordance with the prevailing law and regulation.
(2) Citrus seeds which are circulated should be accompanied by a label certification-pass issued by the Office of Supervision and Certification of Food Plant and Horticulture Seed or other accredited certification agency, at the place of origin.
(3) Label as referred to in Paragraph (2) should be accompanied in every citrus seeds or its packaging, in accordance to the prevailing law and regulation.
(4) Certification as referred to in Section (2) shall be done pursuant to the prevailing law and regulation.
(5) Circulation of citrus seed inter-island should pass through the entry and/or exit point, which is stipulated by the Government.
CHAPTER III
CIRCULATOR OF CITRUS SEEDS
Article 3
Each circulator of citrus seed with the trading purpose shall have registration license pursuant to the prevailing law and regulation.
Article 4
(1) Circulator of citrus seed inter-island shall report and submit the distributed citrus seeds to Plant Quarantine officer at the exit and entry point for health examination.
(2) Circulator of citrus seed inter-island or inter-region in an island shall report the distributed citrus seed to the officer of the Office of Supervision and Certification of Food Plant and Horticulture Seeds at the destination point for the performance of label authenticity as referred to in Article 2 Section (2).
CHAPTER IV
EXAMINATION
Article 5
(1) Health examination of citrus seeds at the exit point is performed by the Plant Quarantine Officer by checking the existence of label as referred to in Article 2 Section (2).
(2) If after examination at the exit point, the citrus seed:
- a. not accompanied with label as referred to in Article 2 Section (2), the exportation of citrus seeds shall be rejected;
- b. accompanied with label as referred to in Article 2 Section (2) and free of plant pest, Plant Quarantine Officer shall issue a Health Certificate;
- c. accompanied with label as referred to in Article 2 Section (2), but not free of plant pest, the citrus seed shall be subject to detention inside or outside of quarantine installation for treatment.
(3) If after treatment as referred to in Section (2) point c, the citrus seeds:
- a. could not be free of plant pest, the exportation of citrus seeds shall be rejected;
- b. could be free of plant pest, the citrus seed shall be given Health Certificate by the Plant Quarantine Officer.
Article 6
(1) The circulator shall report and submit the distributed citrus seed to the Plant Quarantine Officer at the entry point for health examination.
(2) If after examination the citrus seeds:
- a. accompanied with label as referred to in Article 2 Section (2) and health certificate as referred to in Article 5 Section (2) point b and no suspicion that the citrus seed is not free of plant pest, the citrus seed shall be given Health Certificate;
- b. not accompanied with label as referred and there is suspicion that the citrus seed is not free of plant pest, the importation of citrus seed shall be rejected;
- c. accompanied with label as referred to in Article 2 Section (2) and health certificate as referred to in Article 5 Section (2) point b and Section (3) point b, but the citrus seed is not free of plant pest, the citrus seed shall be subject to detention inside or outside of quarantine installation for treatment.
(3) If after treatment as referred to in Section (2) point c, the citrus seed:
- a. could not be free of plant pest, the exportation of citrus seed shall be rejected;
- b. could be free of plant pest, the citrus seed shall be given Certificate of Clearance by the Plant Quarantine Officer.
Article 7
(1) Officer of the Office of Supervision and Certification of Food Plant and Horticulture Seed, perform examination on imported citrus seed into the region as referred to in Article 4 Section (2).
(2) If after examination, the citrus seed:
- a. not accompanied with label as referred to in Article 2 Section (2), the importation of citrus seed shall be rejected;
- b. accompanied with label as referred to in Article 2 Section (2), the citrus seed shall be given Letter of examination-pass and could be circulated in destination area;
(3) Provision regarding the implementation of examination as referred to in Section (1) shall be further regulated by the Director General of Food Plant and Horticulture.
Article 8
(1) Citrus seed which its exportation or importation has rejected as referred to in Article 5 Section (2) point a, and Section (3) point a, or Article 6 Section (2) point b and Section (3) point a, shall be returned to the place of origin or subject to destruction.
(2) Cost of returning to the place of origin or for destruction as referred to in Section (1) shall be borne by the circulator of citrus seed.
CHAPTER V
SURVEILLANCE
Article 9
Office of Supervision and Certification of Food Plant and Horticulture Seed shall responsible for the supervision of quality of citrus seed which is distributed in its region.
CHAPTER VI
COORDINATION
Article 10
Implementation of circulation of citrus seed for public needs in the region, shall be coordinated by local Regional Government.
CHAPTER VII
CLOSING
Article 11
As this Decree becomes effective, Decree of the Minister of Agriculture No. 737/Kpts/TP.630/ 11/1985 concerning Transportation of Citrus Plants and/or Citrus Seed to Prevent the Dissemination of CVPD Disease is declared void.
Article 12
This Decree shall come into effect at the date of issuance.
